Jury to decide Roundup case
Aventis charges Monsanto drove competitors from market

NEW YORK (CBS.MW) - A federal judge in Manhattan ruled there is enough
evidence to bring to trial a lawsuit brought by Aventis Environmental
Science USA against Monsanto Co questioning the methods used to preserve
the market dominance of the herbicide Roundup. U.S. District Court Judge
Loretta Preska in a ruling released Thursday found that there are enough
material issues for a jury to decide whether Monsanto drove competitors
from the herbicide market while depriving Aventis "the benefit of its
bargain." Monsanto officials did not immediately return phone calls
seeking comment on the case. Aventis produces herbicides which compete
against Roundup. Monsanto and Aventis have a history of suing each other
over their genetically engineered crop products.
