Arcata City Council Adopts anti-GMO Ordinance

At it's regularly scheduled meeting on November 17, the Arcata City
Council, by a unanimous 4 - 0 vote, became the first city in California
to adopt an anti-GMO ordinance.

Ordinance 1350 adds a chapter to the Municipal Code to declare the sales,
distribution, propagation, cultivation, raising or growing of genetically
engineered organisms a public nuisance and subject to criminal enforcement.

"The city council was totally behind this from the start," said Jim
Ferguson, former Campaign Manager of Measure M, the flawed Humboldt
County anti-GMO initiative, who worked with City Attorney Nancy Diamond
and Sonoma based Occidental Arts and Ecology Center Director Dave Henson
crafting the language of the ordinance. "At the meeting tonight, not only
did no one speak against it, but the ones who did thought the council
hadn't gone far enough."

The council also directed that a letter be sent, along with a copy of the
ordinance, to the Humboldt County Board of Supervisors, urging them to
implement similar legislation.

The new ordinance takes effect in 30 days.

XIV. ORDINANCES: FOR INTRODUCTION; FOR ADOPTION.

A.  Adopt Ordinance No. 1350 - Amending the Arcata Municipal Code, Title
 V - Sanitation  and Health; Adding Chapter 10 - Genetically Modified
Organisms; Section Prohibiting Genetically Modified Organisms.

At the November 3, 2004 Council meeting, the Council introduced Ordinance
 No. 1350, adding a chapter to the Municipal Code to declare the sales,
distribution, propagation, cultivation, raising or growing of seeds or
crops of genetically engineered organisms a public nuisance and subject
to criminal enforcement. The Ordinance contains two exceptions to the
prohibited activity: 1) the purchase, sale or distribution of genetically
 engineered human food, animal feed or other agricultural products that
lack the potential to reproduce through pollination or seed dispersal,
and 2) medical or agricultural research adequately contained to prevent
the escape of genetically engineered organisms from the laboratory.

RECOMMENDATION: 1) Adopt Ordinance No. 1350, waive reading of the text
and consent to read by title only.
