Monsanto lost again in BRAZIL

It was anounced yesterday that the Presidente of The Federal
Court* from 1st Region (Brasilia) of Brasil, Mr. Plauto Afonso da
Silva Ribeiro said NO to Monsanto's petition to anull the
previous decision of Mr. Justice Antonio Souza Prudente, who had
refused permission for planting of Roundup Ready Soybean in
Brazil before Environment Impact Assessments had been carried
out. Monsanto presented its petition on 7 July. On Friday, 9 July
the President of TRF said NO, arguing that the relevance of this
matter requires more time to judge it carefully.

However, the Courts and Judges in Brasil do not work in July. It
means that any further legal decisions will not be made before
August. As indicated by the Minister of Agriculture on his recent
visit to the UK, it will be impossible for Monsanto to sell
Roundup Ready Seeds before the next planting season. The
Government Lawyers Service have not yet presented a petition to
challenge the Judge's decision. They will do so in August. Below
is the news published in the main newspaper of Rio Grande do Sul,

Mantida proibio do plantio

O plantio da soja transgnica resistente ao herbicida Roundup
Ready continuar suspenso no pas pelo menos at o retorno das
atividades do Poder Judicirio, em agosto. O presidente do
Tribunal Regional Federal (TRF) da 1 Regio, Plauto Afonso da
Silva Ribeiro, indeferiu pedido da empresa Monsanto do Brasil
para a suspenso da liminar concedida pelo juiz federal Antnio
Souza Prudente, da 6 Vara de Braslia, que impede o plantio da
soja transgnica at que seja realizado estudo prvio de impacto
ambiental. A deciso, anunciada ontem, poder atrasar os planos da
Monsanto de vender as sementes modificadas a partir de setembro.

A Monsanto entrou com agravo regimental no Tribunal Regional de
Recursos, no dia 7 de julho, com pedido liminar para a suspenso
dos efeitos da deciso do juiz Antnio Prudente. Na sexta-feira,
dia 9, o presidente do TRF negou a liminar, ressalvando, no
entanto, que face relevncia do assunto, todos os procedimentos
deveriam ser tomados para que o tribunal possa apreciar e julgar
a ao to logo termine o recesso do Judicirio. A ao que suspendeu
temporariamente o plantio da soja transgnica no pas movida pelo
Instituto Brasileiro de Defesa do Consumidor (Idec) e pela
organizao ambientalista Greenpeace.

A Advocacia-Geral da Unio tambm pretende recorrer da deciso do
juiz Antnio Prudente, mas dever aguardar o reincio dos trabalhos
do Judicirio. Enquanto isso, todas as decises referentes soja
transgnica esto suspensas. No dia 9 de junho, o Ministrio da
Agricultura registrou as primeiras cinco variedades de soja
transgnica desenvolvidas no Brasil.
